TERMS AND CONDITIONS
These terms and conditions govern the relationship between you, the passenger, and us, Sirinket Adventure Safari (hereinafter, “SAS”). By booking a trip, you agree to be bound by these terms and conditions. They outline, among other things our cancellation policy and certain limitations of liability. These terms affect your rights to sue, governing law, forum and jurisdiction. The information in your holiday terms and booking conditions is very important as it forms the basis of your agreement with Sirinket Adventure Safaris and we ask you to read it carefully and make sure you understand. In particular, the booking conditions detail our responsibilities to you and yours to us and provide guidelines to cover circumstances which may arise. When you sign the booking form or acknowledge agreement of our booking conditions via our online booking site, you are confirming that you have read the booking conditions and agree to be bound by them.
We strongly recommend you purchase travel protection in order to protect your vacation investment.
RESPONSIBILITY- LIMITATION OF LIABILITY
The responsibility of Sirinket Adventure Safaris and its affiliated companies is strictly limited. As a travel agent, SAS organizes, promotes and sells tour programs consisting of certain travel services, including surface and air transportation, hotel accommodations that SAS purchases or reserves from various suppliers. (Collectively, “suppliers”). SAS does not own or operate any of these suppliers. The suppliers providing travel services for SAS’s tour programs are independent contractors, and are not agents or employees of SAS. As such, SAS is not responsible for any negligent or willful act or failure to act of any suppliers or any third party. SAS is not responsible for any purchase you make during your trips, whether that merchant is part of the scheduled itinerary or not. By utilizing the travel services of the suppliers, you agree that you will look to such suppliers for any accident, injury, property damage, or personal loss to you or to those traveling with you, and that neither SAS nor any representative of SAS shall be liable.
Without limitation, SAS is not responsible for any injury, loss, or damage to you or your property, death, delay, or inconvenience in connection with the provision of, or failure to provide, any goods or services occasioned by or resulting from - but not limited to - acts of God or force majeure,acts of war or civil unrest, insurrection or revolt, strike, criminal or terrorist activities of any kind, overbooking or downgrading of accommodations, mechanical or other failure of airplanes or other means of transportation or for the failure of any transportation mechanism to arrive or depart on time, sanitation problems, lack of medical care, or any other cause beyond the direct control of SAS.
There are certain inherent travel risks of the type involved here. These include, but are not limited to, risk of water rafting, kayaking and rafting (for example dangers of rapidly moving water, rocks and submerged objects), horse back riding, (for example, unpredictable behaviors by the horses, being spooked, etc), walking safaris and in all trips dangers of animals, inaccessibility to medical attention and difficulty in evacuation from remote locations in the case of emergency. A passenger assumes all such risks with regard to these possibilities.
To the extent that SAS is involved in booking air transportation for you, SAS acts as an agent of the air carrier and not as your agent. For all other purposes, SAS does not act as an agent for any party whatsoever.
SAS reserves the right to correct pricing errors at any time, to increase the program prices in the event of cost increases due to changes in airfares, currency fluctuations, park fees increases, taxes, or fuel surcharges. SAS reserves the rights to decline to accept or retain any person as a member of any tour or to cancel or alter the tour without notice, in which event your sole remedy shall be a prorated refund for any unused portion of the trip. Hotels and other accommodations are subject to change.
HEALTH REQUIREMENTS
You must advice us in writings, at or prior to booking, of any physical, emotional or condition which may require professional attention during the trips or may require the use of special equipment. If you fail to disclose any such conditions, SAS may refuse to allow you to take the trip and will forfeit the trip cost; and in such event we shall have no liability, financial or otherwise.
Immunization requirements vary from country to country. You may also visit the website of the Centers for Disease Control and Prevention (CDC) (www.cdc.gov/trave). Additionally, we strongly recommend you consult your personal physician since some itineraries include areas of high altitude and extreme temperature fluctuation. Bring this to your doctor’s attention. Required inoculations, if any, must be recorded by traveler’s health practitioner on a valid vaccination certificate which the traveler must carry for proof of inoculation where required. Individuals with physical handicap, advanced pregnancy, or mental illness should not participate in these rigorous travel programs.
Your health and safety during your trips are our first concern, but SAS is not a medical facility. You should be in good health to participate in our adventure.
SAS reserves the right to decline any trip participant whose condition, in our opinion, may affect the health, safety or enjoyment of other participants. SAS is not responsible for the cost of any medical treatment you may require during the trip. Under no circumstances is SAS responsible for the quality of medical care, or lack thereof, you may receive while on the trip.
BASIS OF RATES
All prices are based on two persons sharing a room. All prices and fares are quoted in US dollars.
The rates are based on current tariffs and are subject to changes due to unforeseen circumstances. While we will do everything possible to maintain the listed prices, if it is necessary to levy a surcharge we reserve the right to do so and notifications will be given at the time of final invoicing.
ELIGIBILITY
Anyone under 18 years must be accompanied by a parent or guardian for the entire journey. For family expeditions; children must be the minimum age indicated in the trip itinerary. Otherwise, there are no age restrictions. All trip members are expected to be in good health. We consider our programs to be active. Moderate to strenuous exertion including long walks and climbing stairs is sometimes an integral part of your travel program. Riding in customized safari vehicles on rough terrain can aggravate back conditions.
COST OF THE TRIP INCLUDES
Tour prices are valid to December 2009 (2010 tour pricing details will be subject to final confirmation).
We design and price our trips to be highly inclusive, while still making it possible for you to exercise some personal preferences. That means we include all the essentials - accommodations, most meals, extensive sightseeing, game drives -- but leave some room for you to explore on your own or to enjoy some meals away from the group.
Accommodation and meals as indicated in the itinerary (B= breakfast, L= lunch, D= dinner) and departure transfer (regardless of arrival and departure days); fully guided sightseeing as noted in the itinerary ( including park entrance fees); bottled water supplied during sightseeing; $100 frequent traveler credit towards your next SAS safari; selected beverages with group meals; private ground transportation throughout your safari, service of SAS experts, guides; internal airfare is included on some itinerary, excursion.
COST OF THE TRIP DOES NOT INCLUDE
International and internal airfares (unless specifically stated as included); costs and fees to obtain or extend your passport/s; visa fees and processing fees; inoculations and vaccinations (if required); health certificate; airport taxes and country departure taxes (if applicable); excursion noted as optional in the itinerary; all items of a personal nature including, telephone calls,laundry,game drives not included in the itinerary, alcoholic beverages (except on certain occasions): meals not specified, tips to tour guides; excess baggage charges; cancellation, health, accident and baggage insurance; and any items not specifically listed as included.
SPECIAL TOUR CONDITIONS
Gorilla Tracking: All Gorilla tracking bookings require an additional, nonrefundable handling fee of $150.00 per person to request permit availability. Once permits are obtained, they must be paid in full and are nonrefundable. Mt. Kilimanjaro Climb: An additional, nonrefundable fee of $150.00 is required to process any Mt. Kilimanjaro Climb request.
TRAVEL DOCUMENTS
All passengers require a passport valid for at least the duration of your trip. In addition, at the time of printing, US citizens are required to have visas for entry into Tanzania, Kenya, Rwanda and Uganda. Visa requirements are subject to change without notice, and we recommend you check with the appropriate embassy or consulate.
You are responsible for obtaining any travel documents and/or verifying entry requirements necessary for each country of travel and/or transit on your selected itinerary. SAS cannot obtain personal travel documents for customers or assume responsibilities for notice of countries current requirements. You are responsible for any expenses incurred as a result of the delays or itinerary changes related to your lack of appropriate travel documents.
AIRLINE BAGGAGE REGULATIONS
In general, economy class allowance per trip participant is two checked pieces for which the total sum of the 3 dimensions (length plus height and width) does not exceed 106 inches (270 cms). No single piece may exceed the 3-dimensional sum of 62 inches (158 cms). Baggage and personal effects are at owner’s risk throughout the tour. Carrier liability for tour members’ baggage is clearly stated on the passenger contract printed on all tickets; description can also be found for inspection at the airport or city offices of the carrier. Liability for checked and unchecked baggage shall in no event exceed the actual loss incurred by the passenger, subject to proof of the amount of loss. Please read all of the conditions of your ticket. Federal law and treaties limits the amount of recovery for loss of or damage to your luggage or its contents. Luggage allowance may be restricted within a country by regional airlines or air charter flights are determined by weight, usually allow only 22 pounds(15 kgs), soft-sided luggage, per person; limitations are strictly enforced).Carry-on baggage is not to exceed 45 inches and must conform to underseat size requirements of 9*14*22 inches. Please refer to your final documents for restrictions. To protect against such limitations, we strongly recommend that you purchase baggage insurance.
AIR ARRANGEMENTS
To provide you with the lowest possible airfares, SAS takes advantages of special promotional fares. These fares can be quite restrictive and carry cancellation charges imposed by the airlines ranging from 25% to 100%. Therefore, any penalties resulting from flight changes at your request after flights are ticketed will be your responsibility. If you cancel your trip after receiving your tickets, you must return you ticket to SAS before refund (if applicable) is processed.
If you make your own domestic flight arrangements, SAS will not be responsible for any resulting fees from cancellation or changes in international gateway or travel dates.
We recommend that you do not purchase tickets with high penalty charges for changes. If you make your own domestic flight arrangement and you miss your international flight for any reason, SAS can assist with alternate flight arrangements; however, you are responsible for the cost of an alternate flight to your destination, as well as any other expenses incurred prior joining up with your tour group.
SAS is not responsible if an airline cancels or delays a flight. If that occurs, you should work with airline to ensure you arrive at your destination.
SAS will not provide any refund for portions of trips missed due to cancelled or delayed flights.
RESERVATIONS AND PAYMENTS
Land Tour Deposit: a deposit of 40% per person is required to secure your reservation. To secure reservations on a trip departing in 90 days a full payment is required by check at the time of booking.
Final payment for all trips must be received in full by Sirinket Adventure Safari at least 90 days prior to departure, unless otherwise stated. Reservations will be cancelled if final payment is not received by the due date and cancellation charges will apply. Trip prices stated as per person based on double occupancy.
Departure taxes, surcharges and government fees are not part of the trip price and will be billed as a separated item on your invoice.
Every effort has been made to produce pricing information accurately. We reserve the right to correct errors.
Itinerary changes: The itineraries presented in this site are subject to modification by the SAS. Every reasonable effort will be made to operate programs as planned, but alterations may still occur after a final itinerary has been issued.
PHOTOGRAPHY
SAS reserves the right to take photographs during the operation of any program or part thereof and to use them for promotional purposes. By booking a reservation with SAS program members agree to allow their images to be used in such photographs. Program members who prefer that their images not be used are asked to identify themselves to their travel program escort at the beginning of their program.
CANCELLATIONS AND REFUNDS
Because of the special nature of the programs featured in this website, suppliers impose rigid cancellation fees; please be aware that SAS has no control over such fees and cannot make any exceptions to these charges. Note: ALL cancellations must be received by SAS in writing; cancellation/s will be effective when the written notice is received at SAS’s offices in Nairobi, Kenya-East Africa.
If a cancellation is received after SAS is in possession of the initial deposit, but more than 60 days prior to departure, the cancellation fee incurred will be $300 per person. A higher cancellation fee may apply to some tours. If cancellation is received between 59 and 45 days prior to departure the fee incurred will be 25% of the entire tour price. Or, if final payment has been received before 60 days prior to departure, and cancellation occurs, the fee incurred will be 25% of the entire tour price. Cancellation/s received between 44 days and 30 days prior to departure will be charged a fee of 50% of the entire tour price. NO REFUNDS whatsoever will be made for cancellations received within the last 30 days prior to departure. This policy also applies to pre and post-trip extensions.
Processing fee: There is a non-refundable fee of $300 per person for each program you cancel. This low fee reflects only our costs of administering a reservation, and is not intending to be punitive in anyway.
Traveler substitutions are considered reservation cancellation and are subject to the above cancellation fees.
Airfares are subject to different rules and cancellation fees; some may be non-refundable. Details will be provided upon request.
To protect against cancellation charges, we strongly recommend you purchase Cancellation, Protection and Travel Interruption Insurance.
LATE BOOKINGS AND CHANGES
If you book within 60 days of departure, a nonrefundable “rush fee” of $50.00 per person will be assessed. Once your tour is confirmed, any change you make 60 days or more prior to departure are subject to a $100.00 per person change fee. Changes made at 30 days or less before departure will be assessed actual penalties imposed on us by our suppliers, a $150.00 per person change fee.
RESERVATION OF RIGHTS
SAS (when deemed necessary) reserves the right to: make any alterations to the itinerary (including, but not limited to, alterations to substitution of lodges); cancel any itinerary or any part of it; and decline to accept or to retain any person as a tour passenger should such person’s health, mental or physical condition, in the sole opinion of SAS, impede the operation of the trip of the other participants. Tour members are held responsible for being in sufficient good health to undertake the trip. If a passenger is asked to leave while the tour is in progress, that person will be responsible for charges incurred on account of such departure from the tour and/or their return to the U.S.A/Canada. Other than to refund such sum, SAS will accept no further liability or obligation toward that person or third party.
TRIP INFORMATION
Acknowledgement of booking will be sent immediately upon initiation of a reservation. Invoice with appropriate visa applications (if needed) and general information such as reading and clothing suggestions, travel information, anticipated weather conditions, etc. will be forwarded to you upon receipt of deposit. Final tour documents consisting of detailed tour itinerary, vouchers, hotel list, etc., are dispatched from our offices approximately 14–30 days prior to departure.
UNUSED TRIP ITEMS
No refund will be made for any unused accommodations, missed meals, transportation segments, sightseeing tours or any other service. Such unused items are neither refundable nor exchangeable (no exceptions).
GUARANTEED DEPARTURES
Once SAS has accepteddeposits for a SAS trip, the departure is guaranteed, except in case of force majeure, which includes any major events that adversely affect international travel patterns, events that endanger travelers or circumstance beyond SAS’s control among others.
INSURANCE
SAS strongly recommends that you purchase Travel Protection Insurance from your insurance agent. The plan protects you and your investment in the event of a sudden emergency before or during your trip and offers coverage for trip cancellation or interruption, loss or theft of baggage, injury, illness and damage, as well as emergency assistance. SAS will not be responsible if the individual traveler fails to take adequate insurance coverage. Contact your insurance agent for more details.
GROUP SIZE
All SAS trips and their extensions are limited to 2 passengers and no more than 24 passengers per trip. All trips and trip extensions require a minimum number of participants to operate.
SAS reserves the right to change the departure date of any trip, as well as cancels any trip or optional extension that does not reach a minimum level of participation. If SAS changes a departure date for any program to another departure date that departs within 14 days from the original departure, cancellation penalties as described in this document still apply should you subsequently decide to cancel. If SAS cancel any optional extension for which you are booked, cancellation penalties as described in this document still apply should you subsequently decided to cancel the base (main) portion of your trip.
